Acceptance & Parties to Agreement
These Terms of Service (“Terms”) constitute a legally binding commercial agreement executed between you (“Client”, “Patron”, or “Buyer”) and Siyaram Spices, having its registered corporate office at Gali No. 01 Gandhi Nagar Mursan Gate Hathras, Uttar Pradesh - 204101 and GSTIN 09AECPS8971L1ZV. By accessing our digital storefront, registering an account, or placing a purchase order for pure Hathras Heeng and Indian spices, you explicitly accept these Terms in their entirety pursuant to the Indian Contract Act, 1872 and Information Technology Act, 2000.
Client Eligibility & Electronic Contracting
Purchases are reserved exclusively for individuals who have reached the age of legal majority in India (18 years) and possess the full legal capacity to enter into binding contracts. All contractual notices, invoices, and updates are transmitted electronically to your designated email coordinates and mobile phone via SMS.
High-Fidelity Catalog & Craftsmanship Variations
All spices and compounded Asafoetida (Heeng) offered through Siyaram Spices are 100% pure, unadulterated, and compounded directly at our facility in Hathras, Uttar Pradesh under FSSAI License No. 12724056000142.
Pricing, GST & Statutory Invoicing
All catalog prices are denominated in Indian Rupees (₹) unless an alternate currency is selected. In accordance with the Central Goods and Services Tax (CGST) Act, 2017 and State GST legislations, applicable GST (typically 5% on pure spices and compounded heeng) is calculated dynamically at checkout. All purchases are dispatched with a statutory GST tax invoice detailing relevant HSN codes and tax breakdown.
Order Lifecycle, Pending Status & Contract Formation
Strict Contract Formation Protocol: Transmission of an electronic order receipt (e.g. SYR-XXXXXX) confirms receipt of your spice order. A legally binding sales contract is formed upon formal dispatch of sealed packages from our Hathras compounding facility and generation of carrier tracking documentation.
All orders initially register on our platform with payment_status = 'Pending' and status = 'Pending'. We explicitly reject automated assumptions of settlement. Inventory reservations remain valid for a 60-minute checkout window pending cryptographic gateway confirmation.
Payment Gateways & Cryptographic Settlement
We integrate authorized enterprise settlement partners: Razorpay Software Private Limited (supporting UPI, RuPay, Netbanking, Credit/Debit Cards) and Stripe Payments India Private Limited. Orders transition to payment_status = 'Paid' solely upon server-to-server HMAC-SHA256 signature verification. We do not store raw payment card data. In the event of gateway declines or fraud risk flags, orders are transitioned to Failed or Cancelled without liability.
Passage of Title, Delivery & Transit Risk
We assume 100% of the transit risk until physical handover to you or your designated recipient. To preserve spice freshness and hygiene, all shipments are dispatched in tamper-evident, sealed aroma-lock packaging with end-to-end courier tracking. Legal title passes upon full settlement and verified physical delivery.
Statutory Consumer Protections & 7-Day Replacement Protocol
Clients are protected under the Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020. We uphold strict food safety standards with our comprehensive 7-Day Freshness & Seal-Integrity Guarantee. Please refer to our Return & Refund Policy for complete RMA procedural details.
Intellectual Property & Trademarks
All trademarks, trade dress, product formulations, brand imagery, and compounding techniques of Siyaram Spices are exclusive intellectual property. Any unauthorized commercial duplication, counterfeit packaging, or brand imitation is strictly prohibited under the Trade Marks Act, 1999 and Copyright Act, 1957.
Limitation of Liability
To the fullest extent permitted by applicable Indian law, the Company disclaims liability for indirect, incidental, punitive, or consequential damages arising from product handling or consumption outside stated culinary instructions. Our aggregate liability under any claim shall not exceed the actual purchase price paid by the client for the specific spice product giving rise to the claim. Nothing in these Terms limits liability for gross negligence, willful misconduct, or statutory consumer guarantees that cannot be excluded under the Consumer Protection Act, 2019.
Governing Law, Indian Jurisdiction & Arbitration
These Terms and all disputes or claims arising out of or in connection with them shall be governed exclusively by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Hathras, Uttar Pradesh, India. Subject to arbitration, the competent courts at Hathras, Uttar Pradesh, India shall have exclusive jurisdiction.
